Terms and Conditions

Difai Staffing Agency LLC provides recruitment, placement, and staffing services for healthcare professionals, including Certified Nursing Assistants (CNA), Home Health Aides (HHA), Licensed Vocational Nurses (LVN), and Registered Nurses (RN).

1. Services Provided

Difai Staffing Agency LLC offers two service models:

a. Placement Services

Sourcing, screening, and referring candidates for direct hire by the client.

b. Staffing Services (Hourly / Contract Staffing)

Providing healthcare personnel on a temporary or ongoing basis, where Difai Staffing Agency coordinates placement and may handle payroll and scheduling depending on the agreement.

2. Placement Fees (Direct Hire Model)

A placement fee is charged upon successful placement of a candidate.

A placement is defined as:

A candidate being selected and accepting a position with the client.

Payment is due upon placement and prior to the candidate’s start date unless otherwise agreed in writing.

3. Staffing / Hourly Billing (Staffing Model)

For staffing services, clients are billed at an agreed hourly rate per staff member.

Difai Staffing Agency LLC is responsible for coordinating staffing services as outlined in the agreement, including scheduling and, where applicable, payroll.

Billing terms, rates, and minimum hours will be defined per client agreement.

4. Refund Policy

Placement fees are non refundable once the candidate has been placed.

In staffing arrangements, billing is based on hours worked and is non refundable once services have been rendered.

5. Replacement Guarantee

For placement services, Difai Staffing Agency LLC offers a one time replacement within 30 days of the candidate’s start date if the candidate voluntarily leaves or is terminated for cause.

This guarantee applies to replacement only and does not constitute a refund.

6. Client Responsibilities

Clients are responsible for:

    •    Verifying candidate qualifications

    •    Conducting interviews

    •    Completing onboarding requirements

    •    Ensuring compliance with employment eligibility verification (I-9)

    •    Managing day to day supervision of staff

7. Employment Relationship

For placement services, the candidate becomes the direct employee of the client.

For staffing services, employment structure may vary based on agreement, and Difai Staffing Agency LLC may act as the employer of record where applicable.

8. Service Delivery

Services are coordinated remotely and in person, depending on client needs, and may include communication via phone, email, and digital platforms.

9. Agreement Acknowledgment

By engaging Difai Staffing Agency LLC services and proceeding with candidate selection or staffing requests, the client acknowledges and agrees to these terms.
